Immediate Advice Do not talk to the police. Do not give the police a statement even if you think it is favorable. Often the police will not accurately report your statement or you may say things without thinking them through. YOU HAVE THE RIGHT TO REMAIN SILENT. Do not discuss your case by phone with anyone except an attorney. The police may be making what is called a "pretext call" where the police use the complaining witness or another non-police person to make a call to you to try and discuss the alleged crime. The police may be listening in and taping the call for use as evidence in the case against you. If possible, do not talk to anyone except a trusted spouse and/or spiritual counselor and/or attorney about the case. Conversations with friends and family members may be used as evidence against you. |
